Choose the matching path below for the rule, records to keep and next step. These quick checks help you identify where to begin.
My contract says I am an independent contractor
- Record who hired you, pays you, can end the relationship and controls how the work is done.
- Keep schedules, work instructions, messages, IDs and pay records.
- Compare the four-fold test with the actual working arrangement and economic dependence factors.
Which hours count as work?
- Log time spent on duty or at a required workplace, including required tasks before or after a shift.
- Note whether waiting time, on-call restrictions, training or interrupted breaks kept you from using the time freely.
- Compare your log with schedules, messages and payslips before checking unpaid hours.
I need to resign or collect final pay
Immediate resignation depends on a legally recognized cause; otherwise the usual written notice rule applies. DOLE’s general final-pay guidance is release within 30 days after separation, subject to a more favorable policy or agreement. Check unpaid wages, prorated 13th-month pay, convertible leave and any other amount due, less lawful deductions.
Immediate resignation · Final pay guideMy overtime pay looks wrong
For covered employees, ordinary-day work beyond eight hours generally uses 125% of the hourly rate. Rest days, special days and regular holidays use different base rates and overtime premiums; check the exact day and your payslip before computing.

Common Philippine labor-law questions
When can I file a labor complaint?
You may seek assistance when a workplace issue involves unpaid wages or benefits, unlawful deductions, dismissal, or another employment dispute. Start by identifying the issue, preserving records and checking whether SEnA is the appropriate first process.
When is final pay due after resignation or termination?
Final pay generally covers amounts still due after employment ends. The exact amount and timing depend on the applicable rules, records and lawful deductions. See the final pay guide and keep payroll, leave and clearance records.
Can an employee resign immediately?
Immediate resignation may be justified in limited situations, including grounds recognized by law. Review the circumstances and preserve supporting evidence before relying on it. Read the immediate resignation guide.
What evidence should I keep for a labor dispute?
Keep employment contracts, payslips, schedules, notices, messages, attendance records and other materials that show what happened. See the labor complaint evidence guide.
